Participation Waiver, Release of Liability, and Assumption of Risk Agreement
Program Name: Hockey fundamentals with 1001624110 Ontario Inc. operating as Skateseven.
Program Dates: Every Tuesday and Friday morning from 7 a.m. to 8 a.m.
Location: Bill Bolton Arena 40 Rossmore Road, Toronto, On M6G2M7
I. ACKNOWLEDGMENT OF RISKS
I, the undersigned participant, or parent/legal guardian of the minor participant named below, acknowledge and understand that participation in the Hockey fundamentals with 1001624110 Ontario Inc. operating as Skateseven program (hereinafter referred to as "the Program"), organized and operated by 1001624110 Ontario Inc. operating as Skateseven, involves inherent risks, dangers, and hazards that can result in serious injury, disability, death, or property damage. These risks include, but are not limited to:
- Falls on ice or other surfaces.
- Collisions with other participants, coaches, equipment, or rink structures.
- Injuries from sticks, pucks, skates, or other equipment.
- Sudden and unexpected changes in surface conditions.
- Fatigue, overexertion, and dehydration.
- Equipment failure or malfunction.
- Improper use of equipment.
- Negligence of other participants, coaches, or staff.
- Medical conditions, known or unknown, which may be aggravated by physical exertion.
- The unpredictable nature of group activities.
I understand that these risks are an integral part of the sport of hockey/skating and cannot be eliminated without compromising the essential qualities of the activity.
II. ASSUMPTION OF RISK
Knowing the inherent risks, dangers, and hazards of participating in the Program, I voluntarily assume and accept all risks of injury, disability, death, or property damage, whether caused by the negligence of 1001624110 Ontario Inc. operating as Skateseven, its employees, agents, representatives, or otherwise. I confirm that the participant is in good physical condition and does not have any medical conditions that would prevent safe participation in the Program.
III. RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNIFICATION AGREEMENT
In consideration for being permitted to participate in the Program, I hereby agree to the fullest extent permitted by law, to:
- RELEASE AND FOREVER DISCHARGE 1001624110 Ontario Inc. operating as Skateseven, its owners, directors, officers, employees, agents, volunteers, coaches, and representatives (collectively, "the Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, injury (including death), or expense that I or the minor participant may suffer, or that my next of kin may suffer, as a result of my/the minor participant's participation in the Program, due to any cause whatsoever, including the negligence of the Released Parties.
- WAIVE any and all claims that I or the minor participant have or may have in the future against the Released Parties.
- INDEMNIFY AND HOLD HARMLESS the Released Parties from any and all liability for any property damage, personal injury, or death to any third party, resulting from my/the minor participant's participation in the Program.
IV. MEDICAL TREATMENT CONSENT
I authorize 1001624110 Ontario Inc. operating as Skateseven, its employees, or agents to obtain emergency medical care for the participant in the event of an injury or illness during the Program, if, in their judgment, such care is necessary. I understand that I am responsible for all medical expenses incurred.
V. PHOTOGRAPHY/VIDEO RELEASE (Optional)
I hereby grant 1001624110 Ontario Inc. operating as Skateseven permission to use photographs and/or videos of the participant taken during the Program for promotional, marketing, or educational purposes in print, online, or in any other media, without further compensation or notification. VI. PARTICIPANT RESPONSIBILITIES
I agree that the participant will abide by all rules and regulations set forth by 1001624110 Ontario Inc. operating as Skateseven and its coaches. I understand that failure to do so may result in removal from the Program without refund. I also confirm that the participant will wear all required and appropriate safety equipment, in good condition, as specified by the Program.
VII. GOVERNING LAW
This agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of laws principles.
VIII. SEVERABILITY
If any portion of this agreement is held invalid, the remainder shall not be affected and shall continue in full force and effect.
I have read and understood this Waiver, Release of Liability, and Assumption of Risk Agreement, and I am aware that by signing this document, I am waiving certain legal rights which I or my minor child might otherwise have against 1001624110 Ontario Inc. operating as Skateseven.
